GENERAL TERMS AND CONDITION OF SALE
The General Condition of Sale set the contractual relationships between La Banda Del Riccio® and all users of the Site:
www.labandadelriccio.it and have for the purpose the web purchase of decorative products.
The General Condition of Sale are the only ones applicable and replace any other document.
La Banda Del Riccio® reserves the right to modify them at any time. It is therefore necessary for the buyer to check them before making purchases on: www.labandadelriccio.it
By accessing the Site the buyer undertakes to comply with the General Conditions of Sale.
Any changes made to the General Conditions of Sale are valid from their put on-line and can not be applied to any contracts concluded previously.
Any purchase made on the Site is set by the General Conditions of Sale at the data of the order. The purchaser, confirming the order, accepts without reservation the General Conditions of Sale after having read them.
The contract between La Banda Del Riccio® and the purchaser must be understood concluded with the acceptance of the order by La Banda Del Riccio®. By placing an order in the manner provided, the purchaser declares he has taken full view of all the particulars provided to him during the purchase procedure, and accept in full the General Conditions of Sale and payment listed below.
If the purchaser is a consumer (purchasing goods for not professional activity), once the procedure has been completed, will save an electronic copy and in any case will retain the present General Conditions of Sale in accordance with the provisions of the art. 3, and 4 D.Lgs. 185/1999 (distance sales).
With regard to the protection of confidentially, it will be subject to the legislation (D. Lgs. 196/2003 and ss.mm.li) as possibly supplemented and/or modified by the GDPR. Any right of the buyer to compensation for direct or indirect damages to people or thing caused by the non-acceptance or partial acceptance of an order, is excluded.
The buyer can directly purchase the products and services on the Site www.labandadelriccio.it or write to info@labandadelriccio.it indicating the name/code of the product and specifying the preferred characteristics.
The correct receipt of the order will be confirmed by La Banda Del Riccio® through a reply by email sent to the email address communicated by the customer. In the case of non-acceptance of the order La Banda Del Riccio® guarantees the fastest communication to the buyer.
PRICES
The prices shown on the Site are expressed in Euro and they are V.A.T. inclusive (22%). Shipping costs are not included and they are indicated to the buyer when ordering. La Banda Del Riccio® is free to change prices at any time and undertakes to apply the rates indicated on the Site when ordering.
ORDER CONFIRMING AND INVOICING
At the time of payment, an email will be sent to the buyer containing the confirmation document of the order. This document transmits the purchase details, the identification number and the taxable amount added to the V.A.T. amount of 22%.
This document demonstrates the successful transaction but does not constitute a tax invoice as required by Art. 22 V.A.T. decree 633/72 (governing retail trade and similar activities E-Commerce).
If buyer needs an invoice to be issued, must request it during the confirmation of order by filling out the mandatory fields for the invoice header. In countries other than Italy, to request an invoice, will be necessary to contact customer support in advance of the purchase at the following address: info@labandadelriccio.it
COMPLAINTS
This contract is subject to Italian law. The language available to conclude the single contract with the seller is Italian. The buyer accepts the Italian as the language for the contract even where there are courtesy translation of the present General Conditions of Sale or other information on the Site.
La Banda Del Riccio® can not be held responsible for the non execution of the contract or part of it due to errors or omissions attributable to the buyer, or due to force majeure such as total or partial strikes of courier and postal services, communications, transport.
La Banda Del Riccio® can not be held responsible for the consequences due to a bad use of the products sold on the Site. Every complaint must be addressed to La Banda Del Riccio® by writing to: info@labandadelriccio.it
The contract of sale between La Banda Del Riccio® and the buyer is concluded in Italy and set by the Italian law. If the buyer is a consumer, the resolution of civil and criminal disputes arising from the conclusion of this contract (distant sales), is the Court of his municipality of residence, in all other cases, is the Court of Rome.
RIGHT OF WITHDRAWAL
The right of withdrawal can be exercised on all products made by La Banda Del Riccio® on the assumption that the following conditions will occur:
-Quality problem or defects in the goods
-Damage occurred to the goods during transport or delivery
-Non conformity of the goods in relation to the order placed
Names, reductions in size, and colours not foreseen in the catalog, made at the express request of the buyer, are excluded from the right of withdrawal (D.L. 22/5/99 n.185).
To exercise the right of withdrawal, the buyer will have 14 calendar days to return the items from the day he received them. To determinate the date of receipt of the articles we will refer to what is documented by the courier (sign with reserve).

Exercising the right of withdrawal, the costs of returning items are charged to the customer.
Refound procedure in case of withdrawal:
If the withdrawal occurs within 14 calendar days from the date of receipt of the items as documented by the courier, the price paid for the items and the shipping costs incurred to recive the product, will be reimbursed.
In any case, if the withdrawal takes place after the 14 days calendar period, it will not be possible to refound the item and the shipping costs incurred to receive it.
The refound of the item price and shipping costs will be made within 3/5 working days from the return to La Banda Del Riccio®.
La banda Del Riccio® will use the same payment method choosen when ordering (PayPal, wire transfer).
If the returned items show damage or signs of tampering because they have been manipulated they will not be reimbursed, not even the initial and return shipping costs.

DAMAGED PARCEL, RETURNS AND REFUNDS
Once the goods have been received, the buyer is obliged to verify its integrity indicating any anomaly found on the delivery receipt of the courier.
-Not intact packaging
-Wet packaging
-Manipulated packaging
Detected anomalies will be verified by La Banda Del Riccio® with the courier. Refund request will not be accepted for damaged package in the absence of notification made at the time of delivery and indicated on the courier’s receipt (signature with reserve).

Attach to the documentation some explanatory photos of the damaged package and a copy of the delivery receipt issued by the courier (signature with reserve) containing the reporting of the damage. La Banda Del Riccio® will contact the buyer within 24/48 hours to agree on the procedure.
If the products are damaged the buyer will take care to put them in the original packaging or in an appropriate wrapping inserting in the package the name/surname associated with the account with which it was executed and the order number.

Refund procedure in case of damaged package:
If the return will take place within 14 calendar days, the price payd will be reimbursed. It will also be reimbursed the shipping costs related to the shipping method with which the product was received and the costs incurred in the return.

RETURNS AND REFUNDS FOR DAMAGED OR NON-COMPLIANT GOODS
Upon receipt of the goods, the buyer is required to verify its integrity and compliance with the order.
In exceptional cases it could be possible to receive a damaged item or a different subject from the one ordered (colours/dimensions). In this case the buyer must, within 24/48 hours from receipt of the goods, communicate the non-integrity or non-compliance of the order.

REFUND PROCEDURE IN CASE OF NOT-INTACT OR NON-COMPLIANT GOODS
Send a refund request by mail to: info@labandadelriccio.it for goods that are not-intact or not compliant. Enclose the ship receipt issued by the post office/courier, your data with the name/surname associated with the account with which it was executed and the order number.
The refund will be made within 3/5 working days from receipt of the item by the payment method chosen at the time of order.
If the return will take place within 14 calendar days, the price payed will be reimbursed. It will also be reimbursed the shipping costs related to the shipping method with which the product was received and the costs incurred in the return.
In any case, if the return will take place after 14 calendar days, it will not be possible to refund the item and shipping costs.

TERMS OF PAYMENT
CREDIT CARD: The buyer can make the payment through PayPal using a guaranteed and secure platform. As soon as the payment is validated you will receive a confirmation email.
You can also pay with your credit card using the PayPal getaway (VISA, MASTERCARD, MAESTRO, VISA ELECTRON, AMERICAN EXPRESS, AURA, DISCOVER).
WIRE TRANSFER: following the path indicated in the purchase procedure, the buyer can select the order details, view the amount to pay, and enter the data required for the transfer.
As soon as the credit has been validated, you will receive a confirmation from La Banda Del Riccio®; the order will be processed immediately and the payment method will be subjected to the economic conditions of your bank.
Cash on delivery payments are not provided.
SHIPPING
The creations of La Banda Del Riccio® are mostly customized and based on buyer’s requests; they will be realized only after confirmation of the order and after its payment.
For customized products it will take 3/5 working days. In the case of available goods for immediate delivery shipping, will take 2/3 working days.
The goods will always be sent to the address that the buyer will have indicated in the section “shipping address”.
To avoid delays, the buyer is required to provide the following data when checking in:
-Valid email address
-An active phone number (mobile or fix) for the courier.
La Banda Del Riccio® will do everything possible to shorten delivery times. Will not be responsabile for delay in delivery due to buyer’s errors (wrong address/telephone number) or due to force majeure. In the particular case due to total or partial strikes of mail carriers, transport, and communication.
For shipments, La Banda Del Riccio® relies on specialized couriers to offer the best service to buyer. Once the order has been processed, the buyer will receive an email notification that carries the traceability code.
